1. Introduction

These Terms and Conditions ("Terms") govern your use of AI Annie ("Service"), part of My-AI-Crew.com and operated by Capipal Lab AB, a company registered in Sweden with organization number 559570-0401, located at Bondegatan 45, Stockholm, Sweden ("Company", "we", "us", or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

2. Definitions

• "Service" refers to AI Annie, including all features, functionality, and content.
• "User" refers to any individual or entity that accesses or uses the Service.
• "Account" refers to a unique account created for you to access our Service.
• "Content" refers to any information, data, text, images, posts, or materials submitted to, uploaded to, created by, or displayed on the Service.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

4. Subscription and Payments

Some features of the Service require a paid subscription. By subscribing, you agree to:

• Pay all applicable fees as described at the time of purchase
• Provide valid payment information
• Authorize us to charge your payment method for subscription fees

Subscriptions automatically renew unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings. Refunds are handled according to our refund policy and applicable Swedish consumer protection laws.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Submit images or content you do not own or have permission to use
• Use the Service in breach of the rules of the social media platforms you connect
• Upload malicious code or attempt to compromise the Service
• Attempt to gain unauthorized access to any portion of the Service
• Use the Service to transmit spam or unsolicited communications
• Interfere with or disrupt the integrity or performance of the Service

6. Intellectual Property

The Service and its original content, features, and functionality are owned by Capipal Lab AB and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of any Content you submit to the Service. By submitting Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such Content solely for the purpose of providing the Service to you.

7. User Content

You are solely responsible for any Content you submit to the Service and for the posts published to your accounts. You represent and warrant that you have all necessary rights to submit such Content and that it does not violate any third-party rights or applicable laws.

8. AI-Generated Posts and Publishing

The Service uses artificial intelligence to write posts, select and create images, and publish them to the social media accounts you connect, on the schedule you choose.

AI-generated output may contain errors, omissions or inaccuracies. You can review, edit or stop posts at any time, and you remain responsible for the content published to your accounts.

Your use of connected platforms such as Instagram, Facebook and LinkedIn is also governed by their own terms. We are not responsible for changes, outages or actions taken by those platforms, including limits on your accounts.

Customer Data is not used to train public artificial intelligence models or third-party foundation models unless explicitly agreed in writing.

9. Customer Data and Ownership

Customers retain all rights, title, and interest in and to any Content, images, files, and other data submitted to the Service ("Customer Data").

We acquire no ownership rights in Customer Data. By submitting Customer Data, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, process, analyze, transmit, and display Customer Data solely for the purpose of providing and improving the Service.

10. Confidentiality

We will treat Customer Data as confidential information and will not disclose such information to third parties except as necessary to provide the Service, comply with legal obligations, or as otherwise authorized by the customer.

11. Security

We implement commercially reasonable technical and organizational measures designed to protect Customer Data, including access controls, encryption, monitoring, backup procedures, and security practices appropriate to the nature of the Service.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Capipal Lab AB shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, business opportunities, goodwill, data, or anticipated savings.

We shall not be liable for content published to your social media accounts, or for business decisions made by users, based on output generated by the Service.

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service shall not exceed the fees paid by the customer to us during the twelve (12) months preceding the event giving rise to the claim.

13. Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties or representations regarding the accuracy, completeness, reliability, availability, or suitability of the Service or any output generated by the Service.
